Abstract

French Abstract: L’Egypte et Israël ont été le scenario de violentes manifestations populaires ces derniers mois. La Constitution adoptée sous l’influence de Morsi et la jurisprudence de la Cour suprême israélienne en matière d’égalité et de minorité constituent le dernier chapitre du parcours constitutionnel complexe des pays du Moyen-Orient. L’analyse dudit parcours met en évidence, comme élément fondamental, la difficulté de concilier dans un texte une garantie étendue des structures démocratiques et des droits fondamentaux avec la nécessité de sauvegarder la religion dans sa fonction sociale et non seulement spirituelle.

English Abstract: Egypt and Israel have experienced violent popular protest in recent months. The constitution adopted under the leadership of Morsi and the jurisprudence of the Israeli supreme court on the principle of equality and on the protection of minorities’ rights represent the last chapter of the complex constitutional development of the Middle East countries. The analysis shows the fundamental difficulty of reconciling the extension of democratic structures and the effective protection of human rights with the need to preserve religion in its fundamental social and spiritual function.
